This document is an official public offer (the "Offer") to enter into a contract for the provision of paid services of the Nexvy service (the "Service") on the terms set out below.
In accordance with applicable law, completing a payment for the Service constitutes full and unconditional acceptance of this Offer (acceptance). From the moment of acceptance the user (the "Customer") and the operator (the "Provider") are deemed to have concluded a contract on the terms of this Offer.
Before paying, please read the terms of this Offer, the Refund Policy, the Terms of Service, and the Privacy Policy.
1. Subject of the Offer
The Provider grants the Customer paid access to the Service — an online platform for generating digital content (images, video, audio, music) using artificial-intelligence models.
Access is provided on a subscription basis (tariff plans) and/or by purchasing packages of internal credits that are spent on generations. The specific scope, limits, and price are shown at checkout and on the pricing page.
The services are non-tangible (digital). No physical goods are sold and no physical delivery takes place.
2. Price and payment procedure
Prices for the Service are stated on the pricing page and at checkout. For customers in Russia, prices are shown and charged in Russian rubles (RUB).
Payment is made by a one-time, non-recurring transaction (without automatic renewal) using:
- Russian bank cards;
- the Faster Payments System (SBP) via QR code.
Payments in rubles are processed by the acquiring bank (the payment provider) identified at checkout. The Provider does not receive or store full card numbers, CVV/CVC codes, or other card authentication data.
An electronic cashier receipt (cheque) is sent to the Customer in accordance with applicable law to the contact details provided by the Customer.
3. Moment the service is rendered
The service is deemed rendered in full at the moment the corresponding subscription is activated or credits are added to the Customer's balance, which occurs automatically immediately after a successful payment.
Because the service is digital and made available immediately, the Customer agrees that provision begins right after payment.
4. Rights and obligations
The Customer undertakes to provide accurate details, to use the Service in accordance with the Terms of Service, and not to use it for unlawful purposes.
The Provider undertakes to make the paid functionality of the Service available and to provide support at the contact address below. The Provider may engage third parties (AI model providers, hosting, payment providers) to perform the contract.
5. Refunds
The procedure and grounds for returning funds are set out in the Refund Policy, which forms an integral part of this Offer.
6. Liability
The Service is provided "as is". The Provider is not liable for results generated by AI models or for the Customer's use of them. The Provider's aggregate liability is limited to the amount paid by the Customer for the relevant billing period, to the extent permitted by law.
